The results of the norms application of Decree № 40
The Decree of the President of the Republic of Belarus of February 11, 2016 №. 40 "About making amendments and additions to the Decree of the President of the Republic of Belarus" came into force on April 14, 2016.
The document was adopted in order to create a "barrier" for movement of commercial batches of goods under the guise of goods for personal use across the customs border by natural persons. When crossing the customs border more than once every three calendar months, the value of the goods which are transferred in accompanied and unaccompanied luggage for personal use must not exceed EUR 300, and weight - 20 kg.
Since the entry into force of the Decree and until April 14, 2017, the number of refusals to classify natural persons’ goods as goods for personal use because of exceeding the established norms of import was 9.3 thousand. At the same time, about 11.7 million natural persons entered the Republic of Belarus in this period.
Practical application of the norms of the Decree confirmed its effectiveness in suppressing attempts to move commercial batches of goods under the guise of goods for personal use in order to further involve them in trade. Officials of customs authorities detected about 1 thousand administrative violations on importation of similar batches of goods into the territory of the EAEU.
In respect of goods not classified as goods for personal use, 255 goods declarations were filed out. At the same time, the paid customs charges were about 96.2 thousand Belarusian rubles.
These statistics show that the innovations did not affect ordinary citizens who want to buy goods abroad for personal purposes.
There is a lack of problematic issues of the movement across the customs border of goods for personal use by natural persons who go on vocation, travel, for tourist and private purposes, as well as for other purposes not related to business.
