TRANSPORTATION OF PERSONAL USE GOODS DURING THE RESETTLEMENT OF NATURAL PERSONS WHO MOVE TO THE REPUBLIC OF BELARUS FOR PERMANENT RESIDENCE

In line with the Treaty on the procedures for the transportation of personal use goods by individuals across the customs border of the Customs Union and the customs operations required for their release of 18 June 2010 the commodities (including one automobile and one trailer), which are imported by natural persons, who are legally recognized by the Customs Union member state as refugees, forcibly displaced persons, and those, who move into the Customs Union member state for permanent residency, are exempted from customs duties if the following conditions apply simultaneously:

  1. The commodities are used ones;
  2. The commodities were imported from the previous residence country at least 18 months before the date of relocation to a new permanent residency;
  3. The commodities were bought before the resettlement. The automobile and the trailer have been owned and the person claiming the preference has been registered as the owner for at least six months before the resettlement date.

The 18-month period of duty-free import of commodities cannot be extended.

People, who move into the Republic of Belarus for permanent residence and cross the Belarusian section of the Customs Union customs border, are supposed to use procedures stipulated by the regulation on preferential transportation of personal-use goods and their simplified customs clearance that was adopted by Belarus President Decree No. 503 of 15 October 2007.

Provided they have documents to prove their intention to move into the Republic of Belarus for permanent residence, such people are supposed to follow the customs transit procedure and hand over their personal-use goods for temporary storage to customs authorities without depositing money to secure their payment of customs fees. The personal-use goods will be stored until the documents to confirm the resettlement for permanent residence to the Republic of Belarus are acquired.
The documents to confirm the intention to move into the Republic of Belarus for permanent residence are:

  1. The passport of a citizen of the Republic of Belarus PP series – for Belarusian citizens, who return to Belarus for permanent residence after they have been removed from the permanent consular register;
  2. for foreign citizens and stateless persons:
    1. a passport with a Belarusian visa for permanent residence;
    2. a certificate issued by the diplomatic mission of the Republic of Belarus in the previous residence country to confirm the permission to move into Belarus for permanent residence;
    3. a special passport required to move into the Republic of Belarus for permanent residence;
    4. a certificate confirming the removal of the person from the register;
    5. a certificate issued by the citizenship and migration office of an interior affairs body to confirm the acceptance of documents, which have been submitted to acquire permanent residence permits.

To place the goods into temporary storage, the candidate for permanent residence in the Republic of Belarus is asked to submit an application to the customs agency. The application must contain:
information about the candidate taken from the passport or another ID
tentative place of residence
commitment not to use the goods under customs control in deals that involve the transfer of ownership to other persons
name, number, weight and value of each item that is handed over for storage to the natural person (an inventory).

If the person fails to take actions required to submit documents to get permanent residence in the Republic of Belarus, to get a permanent residence permit, to get Belarusian citizenship, to get a Belarusian citizen passport within 60 days after the day the registration of documents required for placing the personal-use goods into temporary storage was confirmed or if the issuance of such documents has been denied, the personal-use goods can be submitted to customs declaration in line with the Treaty. Customs fees will be paid depending on whether the goods will be left in Belarus or exported out of the country. A certificate issued by the citizenship and migration office of an interior affairs body can be used to confirm the actions have been performed.

After the documents that confirm the resettlement to permanent residence in the Republic of Belarus are received, the natural person has to submit a passenger customs declaration while the customs body will release the goods without levying customs fees.

The documents that confirm the resettlement to permanent residence in the Republic of Belarus are:
a residence permit for foreign citizens and stateless persons;
a Belarusian citizen passport with the stamp to confirm their registration in the place of residence in Belarus for citizens of Belarus, who return to permanent residence from abroad, foreign citizens and stateless persons, who arrive in Belarus for permanent residence and have acquired the citizenship of the Republic of Belarus, that is a Belarusian citizen passport other than PP series.

If the natural person has documents to confirm the resettlement to a permanent residence in Belarus, the goods can be released directly at the customs clearance station at the border with providing preferences.
