The order of awards, orders and medals transfer across the customs border
The items of faleristics: orders, medals, badges, etc., made 100 years ago or more (with the exception of state awards of the member states of the Eurasian Economic Union) belong to cultural values, documents of national archives and the original archival documents (hereinafter - the cultural values) section 2.20 of The List of goods in respect of which a permissive order for import into the customs territory of the Eurasian Economic Union and (or) export from the customs territory of the Eurasian Economic Union has been provided, approved by the Decision of the Board of the Eurasian Economic Commission of April 21, 2015 № 30 "About measures of non-tariff regulation."
In case of transfer of orders and medals which belong to the cultural valuesas well as to the goods for personal use by natural person, import/ export of such orders and medals by natural persons is conducted in accordance with the Agreement on the order of goods transfer by natural persons for personal use across the customs border of the Customs Union and on customs operations connected with their export of 18 June 2010 (hereinafter - the Agreement), as well as the Regulation on the export from the customs territory of the Eurasian Economic Union of cultural values, national documents and archives the originals of archival documents, approved by the Decision of the Board of the Eurasian Economic Commission of April 21, 2015 № 30 "About measures of non-tariff regulation" (hereinafter - Regulations).
According to subparagraph 6 of paragraph 2 of Article 8 of the Agreement, the cultural values on import to the customs territory of the Eurasian Economic Union (hereinafter - EAEC), as well as at export from the customs territory of the EAEC are liable to customs declaration in written form by filing out the passenger customs declaration. The form and the order for filling out the passenger declaration are established by the Decision of Union Commission of 18 June 2010 № 287 "About approval of the passenger customs declaration and the procedure of filling out a passenger customs declaration."
At the same time, in accordance with paragraph 4 of the Regulation, the export of cultural values as goods for personal use by natural persons is conducted by a conclusion (permitting document).
In the Republic of Belarus, such conclusion (permit) is issued by the Ministry of Culture of the Republic of Belarus (Regulation on the procedure and conditions for the issuance of the Ministry of the conclusion of the culture (permits) on the export of cultural goods restricted for export from the territory of the Republic of Belarus on non-economic nature, approved by the Council of Ministers Belarus of 23 September 2008 № 1397 "About some issues of the procedure for movement of certain types of goods across the border of the Republic of Belarus").
According to paragraph 6 of the Regulation, the export of cultural values by natural persons as goods for personal use, previously temporarily imported into the customs territory of the EAEC, is carried out by applying the passenger customs declaration to the customs authority of the member state EAEC. The customs passenger declaration must be filled out for import of cultural values, containing identification attributes of these cultural values.
In the absence of the passenger customs declaration filled out for the import of cultural values as goods for personal use, export of cultural values as goods for personal use by natural persons is conducted with the conclusion issued by approval authority, or written notice of approval authority of that the conclusion for export of the cultural property is not required.
Orders, medals, badges, etc., made less than 100 years ago, do not belong to cultural property and may be exported without the opinion (permission).
Permits are not required for import of cultural values by natural persons.
According to subparagraph 4 of paragraph 4.5 of Annex 2 to the Agreement, cultural valuesare prohibited for being imported into the customs territory of the EAEC and (or) export from this territory by international post mail.
