The order of repeated transfer of vehicles registered outside the member states of the Customs Union by foreign natural persons
The order of vehicles transfer by natural persons across the customs border of the Customs Union and conducting customs operations connected with their export is established by Agreement on the order of goods transfer for personal use by natural persons across the customs border of the Customs Union and conducting customs operations connected with their export (hereinafter - the Agreement), which has become legal on 06.07.2010, as well as by the Regulations on the order of customs operations in respect of goods for personal use, transferred by natural persons across the customs border, and the reflection of the recognition of such products out of customs control, approved by Commission Decision of the Customs Union, dated 18 June 2010 №311 (further - the Instruction).
In accordance with paragraph 1 of Article 8 of Agreement, goods declaration for personal use, including vehicles registered in a foreign country is made in written form, using the passenger customs declaration.
According to paragraph 16 of Instruction, in respect of either temporarily imported vehicles into the customs territory or re-exported from the territory, possibility and arrangement for the use of other documents as a declaration is established by central customs authority. The documents are enforced at the time of repeated transfer of vehicles across the customs border.
In the Republic of Belarus, transport mean importation certificate (TMIC) is used as other document at the time of repeated transfer of vehicles for personal use, registered outside the member states of the customs union (hereinafter - foreign vehicles) across the Belarusian part of customs border of the Customs Union by foreign natural person. The form and the order of TMIC are established by resolution of the State Customs Committee of the Republic of Belarus of October 1, 2014 № 51 "About some issues of vehicles transfer for personal use across the customs border of the Customs Union in Belarus”.
Repeated transfer of foreign vehicles across the Belarusian part of the customs border of the Customs Union is permitted only for foreign natural person who is the declarant and who has been previously got TMIC.
Passenger customs declaration is filled out by natural person in one copy at the time of customs vehicle declaring and if the person get wish to have TMIC.
TMIC is executed by the customs authority in two copies. The maximum duration of it is- 3 months.
The first TMIC copy is issued to the natural person who imported the vehicle, or to the customs agent acting in such person name and on his behalf, the second copy is retained at the customs authority.
TMIC is submitted to the customs authority at each transfer across the customs border of the Customs Union. At the same time, at the checkpoints equipped with double corridor system, such transfer is carried out on the "red" corridor.
If natural person at import of vehicle, refuses to use TMIC, at the time of filing TMIC to customs authority for export of the vehicle from the customs territory of the Customs Union, in the Republic of Belarus he got the tick avouching the refuse to use TMIC. The date of refusal and the signature of natural person who imported the vehicle are put.
